In non-capital cases, there are waivable statutory limitations on the compensation to be paid for the investigative, expert, or other services necessary for adequate representation.[18 U.S.C. § 3006A(e)(3)]

For capital representations, there are waivable statutory limitations on the compensation and expenses for furnishing such services. [18 U.S.C. § 3599(g)(2)]

If it can be anticipated that the compensation will exceed the statutory maximum, advance approval should be obtained from the court and the chief judge of the circuit (or judge delegate). [Guide, Vol 7. § 310.20.10]
