Overview

Presiding judicial officers are urged to permit interim payments in capital cases. [Guide, Vol. 7, § 660.40.10] This section discusses policies and procedures that apply to the interim payment of compensation and/or expenses for investigators, experts, and others whose services are obtained under subsection (e) of the Criminal Justice Act (18 U.S.C. § 3006A) or 18 U.S.C. § 3599(f) for capital representations.

The procedures for effecting the interim payments and sample memorandum orders are found in the Guide, Vol. 7, Appendix 3C, Procedures for Interim Payments to Service Providers in Capital Proceedings. [Guide, Vol. 7, §§ 310.60.10-310.60.20]

The service providers, including experts, must submit a single, separate voucher for each interim payment claim and should attach the court order approving interim payments.
