The Form CJA 30 is used for the appointment and compensation of counsel for capital proceedings. This includes cases in which a defendant is charged with an offense that may be punishable by death, whether or not it is determined that the death penalty will be sought; appeals from capital prosecutions; and capital habeas corpus representations. [Guide, Vol. 7, § 630.60]
The form is used by the appointed attorneys to submit their claims for hourly compensation and for reimbursement of expenses incurred during the representation. In capital cases, where appointed counsel (with prior court authorization) use the services of attorneys who work in association with them, the appointed counsel include and itemize those attorney hours on the Form CJA 30. [Guide, Vol. 7, § 620.10.10] See the Guide, Vol. 7, § 230.53.10(b) regarding the use of services of non-affiliated attorneys (with prior court authorization).
The appointed attorney claims reimbursable expenses in boxes 16 and 17 of the Form CJA 30. Attorneys should provide dates and a description of each expense, enter the total claimed, and submit supporting documentation for single item expenses over $50. Click here for further information.
